Protection
of Life: Using the Federal Courts

Before
leaving the States, I tried to decide just what to speak about. There is a lot
of temptation to talk about the Presidential election and the ongoing court
battles in Florida. The fact that I am a former judge from Florida who was a
party to an election contest ultimately resolved by the Florida Supreme Court
might make such a talk very timely. However, I was wise enough to ask Jean, my
wife, what she felt my topic should be. There was no hesitation: speak about
what God wants you to say.
One thing
that I feel certain that God wants you to hear is a quote from Proverbs 24,
verses 5 and 6. I have been led to these verses several times. It is
appropriate that I repeat them to you.
A wise man is more powerful than a strong man.
And a man of knowledge more so than a man of
might.
For it is by wise guidance that you wage your
war,
and the victory is due to a wealth of
counselors.
As you may
have guessed, the subject of this address is “counselors”.
The
Counselor Corps
tries to train Christians to stand at the doorway to abortion clinics and there
offer love and help to all persons going in or coming out. The counselors act
in a lawful manner. They do not debate the legality or morality of abortion. Simply
put, the counselors offer alternatives to abortion and encourage the pregnant
women to accept their help.
As much as
possible, the counselors follow the directions set out by Jesus Christ in the
parable about the Samaritan on the Jericho road. The Good Samaritan did not let
the failure of the priest or deacon deter him from offering help and first aid,
in a loving manner, to the battered Jewish business man who was lying in a
ditch. The Samaritan did not force his help on this victim nor did he offer to
debate the problem or petition the government for more laws. The Samaritan
provided first-aid and took the victim to an innkeeper, someone who could
provide long term care, someone who was in the business of helping travelers.
Please note
that the Samaritan was a volunteer who rendered short term assistance. His task
would have been much different if there were no innkeepers. We think of the
crisis pregnancy centers, pro-life doctors, shelters for abused women and homes
for unwed mothers as the innkeepers. Without them, it’s tough to be effective
as a Samaritan - sidewalk counselor.
As part of
our program, we are using the federal law called F.A.C.E. to protect the
Christians. The abortion industry convinced the United States Congress to pass
a law in 1994 which made it a serious crime to interfere with reproductive
health service providers at abortion clinics. Since we in the United States
have a legal concept called “equal protection”, a concept that says that all
activity which is legally protected cannot be discriminated against on account
of the ideals or beliefs of the participants. Thus, we are using the abortion
industry’s own weapon against it.
Some of the
cases involve lawsuits against abortion clinics and their protectors, the local
police. Another case has been brought against William Clinton, the President,
and against Janet Reno, the Attorney General of the United States. A most
significant case has been brought on behalf of a woman who was prevented from
leaving an abortion clinic.
Not only
does F.A.C.E. guarantee entrance into an abortion clinic, it also protects the
right to leave these places. That is what my client, “Jane Roe, II”, wanted to
do. The woman we call Jane Roe, II had previously had abortions and knew what
to expect. When the abortionist started on her, Jane knew that it was being
done incorrectly. She told him to stop. Not only did the abortionist refuse to
stop, he got four assistants to hold Jane on the table. She screamed for help. She
screamed for an ambulance while the abortionist lacerated her colon and slashed
holes in her uterus. The little unborn baby was finally killed by the
abortionist but not removed from the mother. Jane believed that the abortionist
was going to kill her as well. At long last, the ambulance crew was called and
allowed to take Jane to the emergency hospital. The abortion clinic told the
ambulance driver to drive slowly, not to use the flashing lights as they did
not want anyone to know there had been a problem at the clinic.
On the way
to the hospital, my client cried out to God, begging for his forgiveness. She was
bleeding profusely and in danger of death. She asked that God would spare her
life. At the hospital, the doctors managed to remove the dead child and to keep
Jane alive. There was massive surgery to repair her organs. Later, the hospital
registered Jane under a fictitious name and stationed security guards at the
door to her room to keep the abortion clinic people away from her.
I’m pleased
to report that my client continues to grow as a Christian and is very grateful
for all the love and support she has received from the counselors. Her lawsuit
is pending before the U.S. Court of Appeals and may result in a very
significant defeat for the abortion industry. It has also pointed out the
pressing need for a national policy against forced abortions. It is most
important that forced abortions be outlawed in every nation of the world which
permits these operations.
Every
abortion is a crime against the child. Every forced abortion is a crime against
the mother and the child. It is our estimate that thirty percent or more of the
total abortions should be classified as “forced abortions”. Linda Bell of Florida
Right To Life has estimated the number of forced abortions to be as high as
seventy percent. I have heard of higher percentages from other people. Regardless,
the potential life-saving of forced abortion legislation is enormous. Such laws
will be virtually veto-proof and judge-proof.
